Social Security Disability Claims

You have certain rights as a citizen of the United States. The Social Security Administration must pay benefits to disabled workers and their dependents under Title II of the Social Security Act. A type of benefit known as Supplemental Security Income may be available to disabled children or those who have not worked enough to be insured and whose assets and income fall below certain poverty levels. Social Security defines disability as the inability to do substantial work because of a severe medical condition (or a combination of conditions) which is expected to last at least 12 months or result in death. The definition of disability is much more complex than it appears on the surface. A claimant’s age, education, and past work experience can play a significant role in the outcome of a case, and a letter from your doctor that says you are “disabled” may not be enough to convince Social Security that you are entitled to benefits.

Most cases are denied in the initial stages and a claimant must appeal. In many cases a claimant will need to appear and testify before an Administrative Law Judge before their case is approved.
