Can I Seek Compensation After a Loved One Has Died in a Pedestrian Crash in Charlotte
Families who lose a loved one in a pedestrian crash may have the right to pursue a wrongful death claim. Financial recovery can include funeral costs, medical bills from emergency care, and the loss of income the person would have earned. They may also seek damages for loss of companionship and support.
Insurance companies start investigating right away. Adjusters may contact the family within days. Speaking with a lawyer before giving a recorded statement can help protect your interests. An attorney can gather police reports, review surveillance footage, interview witnesses, and work with crash reconstruction experts when needed.
Acting quickly also helps preserve evidence. Traffic camera footage and witness memories can fade with time. Early action strengthens a potential claim.
Pedestrian crashes in Charlotte continue to raise serious safety concerns. Central Avenue sees steady traffic, especially in the evening. Drivers and pedestrians share the same space, and one mistake can turn deadly.
In North Carolina, about 270 pedestrians were killed in 2022 in crashes involving motor vehicles, up from the prior year, and pedestrian deaths have generally increased over the past decade, according to state crash data. Pedestrian and bicyclist fatalities made up a significant share of all roadway deaths statewide.
Preliminary 2024 data suggest more than 130 pedestrians were killed in the first half of the year, indicating a continued concerning trend.
North Carolina law requires drivers to yield to pedestrians in marked crosswalks. Drivers also must use caution near intersections and bus stops. Pedestrians have duties as well. Even a crash at moderate speed can cause fatal injuries.
